Liability, Waiver, and Indemnity Agreement for Private Ballet and Dance Lessons for Adults and Children
This Agreement (hereinafter referred to as the "Agreement") is entered into between the participant (or the parent(s)/guardian(s) if the participant is a minor) and The Centre of Dance PTY LTD (hereinafter referred to as the "Centre").

1. Acknowledgement of Risk

1.1. Participation in private dance and ballet classes involves physical activities that carry inherent risks, including, but not limited to, muscle strain, falls, sprains, and other potential injuries.
1.2. By enrolling in private lessons, the participant (or parent/guardian if the participant is a minor) confirms that they/their child are in good health, physically capable of participating, and aware of these risks.
​2. Release of Liability

2.1. In consideration of being allowed to participate in private classes, the participant (or parent/guardian) fully and irrevocably releases, waives, discharges, and covenants not to sue the Centre, its owners, employees, instructors, agents, and contractors from any and all claims, liabilities, injuries, or damages arising from participation, whether based on negligence or otherwise, except in cases of gross negligence or willful misconduct by the Centre.
2.2. This release is intended to be as broad and inclusive as permitted by the laws of Queensland, Australia.

3. Indemnity
​
3.1. The participant (or parent/guardian) agrees to indemnify and hold harmless the Centre, its owners, employees, instructors, agents, and contractors from any and all claims, demands, or actions, including legal costs, arising out of participation in private classes, including, but not limited to, any injuries, damages, or losses sustained.
3.2. This indemnity also covers any third-party claims related to the participant’s actions or behavior during the lessons.

4. Supervision of Minors
​
4.1. The Centre is responsible for supervising children only during scheduled private lesson times.
4.2. The Centre is not responsible for the care or supervision of the child before or after these scheduled times unless prior arrangements have been made.
4.3. Parents/guardians must ensure timely drop-off and pick-up of their child.

5. Personal Belongings and Property Damage
​
5.1. The Centre is not responsible for any lost, stolen, or damaged personal belongings brought to the premises.
5.2. If a participant causes damage to the Centre’s property (such as mirrors, barres, floors, or equipment), they (or their parent/guardian) will be financially responsible for repairs or replacements.

6. Emergency Medical Treatment
​
6.1. In the event of a medical emergency, the participant (or parent/guardian) authorises the Centre and its staff to administer first aid and/or seek immediate medical treatment.
6.2. All costs associated with emergency medical treatment shall be the sole responsibility of the participant (or parent/guardian).

7. Special Medical Conditions
​
7.1. The participant (or parent/guardian) must disclose any medical conditions, allergies, or special needs that may affect participation in private lessons.
7.2. The Centre shall not be responsible for managing or administering medication unless a separate written agreement has been made before participation.

8. Media Release
​
8.1. By enrolling in private lessons, the participant (or parent/guardian) grants permission to the Centre to use photographs, video recordings, and other media capturing participation for promotional purposes.
8.2. This includes, but is not limited to, use on social media, advertising materials, and the Centre’s website.
8.3. If the participant (or parent/guardian) does not wish for their image to be used, they must notify the Centre in writing before participation.

9. Governing Law
9.1. This Agreement shall be governed by and construed in accordance with the laws of Queensland, Australia.
9.2. Any disputes arising from or related to this Agreement shall be resolved in the appropriate courts of Queensland.

10. Confirmation of Participation
During registration, the participant (or parent/guardian) must check the designated box, thereby confirming that they have read, understood, and agree to the terms and conditions of this Agreement.
